Terms and condition – Pino Roastery

1. Scope

These Terms & Conditions apply to all orders placed via our online shop by consumers within Germany and the European Union.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

3. Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer but an invitation to place an order.

By clicking the button “Place order”, you submit a binding order for the goods in your shopping cart.
Confirmation of receipt of the order is sent automatically by email and does not constitute acceptance of the contract.

The contract is concluded when we accept your order by sending an order confirmation or by dispatching the goods.

4. Prices and Shipping Costs

All prices shown include the applicable statutory VAT.

Shipping costs are not included in the product prices and are clearly communicated during the ordering process before submission of the order.

We deliver to Germany and selected countries within the European Union.

5. Payment Methods

The following payment methods are available in our online shop:

Credit Card / Payment via Stripe

Payment is due immediately upon conclusion of the contract.

6. Delivery

Delivery is carried out to the delivery address specified by the customer.

Delivery times are indicated on the respective product pages.
If no delivery time is specified, delivery usually takes 2–7 business days within Germany and 5–10 business days within the EU.

7. Right of Withdrawal

Consumers have a statutory right of withdrawal.

8. Exclusion of the Right of Withdrawal

The right of withdrawal does not apply to contracts for the supply of goods:

which are sealed, and
which are not suitable for return for health protection or hygiene reasons,
if their seal has been removed after delivery.

This applies in particular to food products such as freshly roasted coffee.

9. Retention of Title

The goods remain our property until full payment has been received.

10. Liability

We are liable without limitation for damages resulting from intent or gross negligence.

In cases of slight negligence, we shall only be liable for breaches of essential contractual obligations, limited to foreseeable, typical damages.

Liability for personal injury remains unaffected.

11. Applicable Law

German law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

For consumers residing in another EU country, mandatory consumer protection provisions of that country remain unaffected.

12. Online Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR):

We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.

13. Final Provisions

If individual provisions of these Terms & Conditions are or become invalid, the validity of the remaining provisions shall remain unaffected.
